Charles Martell & Son Ltd Terms and Conditions of Sale

Charles Martell & Son Ltd are delighted that you have chosen to purchase some of our fine products, we hope you will enjoy them and tell your friends! This sale is subject to the following terms and conditions which you must agree to for the sale to be completed.

Charles Martell & Son Ltd (“The Company”) is licensed to manufacture and sell alcohol by mail order and the internet in the UK, and by agreeing to these conditions you are entering into a contract with the company. If you choose not to accept these Terms and Conditions you will not be able to purchase any products from the Company.

These Terms and Conditions are to formalise this contract and to inform you of our obligations to you, and your rights and responsibilities to us. You should print a copy of these terms and conditions for future reference. Sorry for the bureaucracy, but it is unfortunately the way of the world these days!

Sale of Alcohol Age Restrictions

We are not allowed to sell alcohol to persons under the age of 18 years, and by agreeing to these terms and conditions you are indicating you are over 18 years old.

The goods must be received by yourself or a designated person that you have authorised, again over 18 years of age.

Payments

Payments are currently only accepted by PayPal; once you have clicked the accept terms box on the order summary page you will be directed to the PayPal website, where your payment will be taken, and the transaction completed. It is at this point you will have entered into a legal contract with The Company. Payments can be taken from a credit or debit card, or billed to your PayPal account should you have one.

Deliveries

The Company only ships to UK addresses. Deliveries are usually made by Royal Mail Parcel Post and this cost and required packaging are included in the prices stated. Delivery time is usually 3-4 days but may take up to 7 working days during peak periods, in poor weather and around Bank Holidays.

We may be able to deliver urgent orders by special courier by arrangement, please contact us for details, before ordering.

We will not accept responsibility should the postal service be unable to deliver to you as a result of incorrect information being entered at the time of ordering, we will not be a Under the terms of our license we are unable to accept orders from or deliver to countries outside the mainland UK.

Availability

The Company reserves the right to discontinue or remove a product from the shop pages without notice. All orders are accepted subject to sufficient stock availability. We will not substitute a product with another without first contacting you.

We may amend the price or any other detail on the website at any time without prior warning, consent or notification, no liability will be accepted for any loss occurred as a result of these changes.

Should orders have been placed which cannot be fulfilled, full refunds will be made.

Delivery

If a shipment is returned to us as a result of the recipient being un-contactable or not responding to a card left by the carriers, a delivery charge will be made before the goods are re-delivered.

Please note that if your order should become lost as a result of you entering an incorrect or incomplete delivery address when placing your order, we will not be held responsible for the loss. Orders will only be delivered to the credit card/PayPal address.

The Company accepts no responsibility if the consignment goes missing or becomes damaged once the delivery has been made.

Returns Policy

Should you have any issues with your order you must notify us within 48 hours of receipt of your order. Failure to do so may result in us being unable to rectify any problems that may have arisen with your purchase.

Damaged items - If any items you have purchased from The Company should be delivered damaged, we reserve the right to request either photographic evidence or the damaged product(s) returned to us in any original packaging. A new item will be dispatched upon receipt and possibly upon investigation.

Erroneous Items - Items sent out in error by The Company will be exchanged for the correct item. Where possible we will arrange for an uplift of the incorrect item(s). Once the item(s) are received back in Dymock we will despatch the correct item(s) to you.

Cancellation of an order - Should you wish to cancel an order that has already been placed and paid for, The Company reserves the right to charge an administration fee of 2.5% of the total order value.

This sale is covered under The Consumer Protection (Distance Selling) Regulations 2000.

Should you decide that you no longer wish to keep the product(s), and wish to return them, they must be in as received condition, unopened, and undamaged in any way. You are responsible for the cost of their return in saleable condition to The Company. You will be entitled to a refund of the purchase price less the cost of the original postage to you, less a handling charge of 2.5%. This will be refunded to the Paypal account that was used to purchase the product, on receipt of the returned goods.
